Clean Air Act 1993
The Clean Air Act covers businesses who are not regulated by the Pollution Prevention and Control Directive, the Integrated Pollution Control regulations or the Local Authority Directives associated with these.
- Businesses must prevent the emission of dark smoke from any chimneys on their premises.
- Businesses must also prevent the emission of dark smoke from any other process on site such as the burning of tyres or cables.
- Local Authorities should be informed prior to any installation of a furnace or fixed boiler, as they must be able to operate continuously without emitting any dark smoke. You must have planning permission for any chimneys along with special approval from Local Authorities under the Clean Air Act.
- Local Authorities can prohibit the emission of dust and grit that reaches nuisance levels and limits can be applied. If these limits are breached then firms can be fined
